All customers must agree to all of the following as part of the checkout process.

We at AB Powersports value your complete statisfaction. If after 14 days of receiving your buggy, you decide you do not want it for ANY reason, just give our customer service folks a call and we will cheerfully refund your money, subject to the following conditions:

1. You must obtain a Return Merchandise Authorization (RMA) number from our customer service department within 10 business days of receipt of your vehicle. Any vehicles returned without an RMA will not be accepted.
2. A copy of your original invoice with the RMA number legibly written on it MUST be included with your return shipment .
3. The vehicle MUST be returned to AB Powersports within 5 business days of our issuing you an RMA.
4. The vehicle MUST be in its original packaging and in new, resellable condition.
5. This return policy does NOT apply to vehicles that have been altered, abused, neglected, have suffered an accident, or have not received proper maintenance.
6. All packaging materials, instruction manuals, and parts MUST be returned. Any missing parts or damages will be deducted from your refund amount.
7. Shipping expenses are NOT refundable and will not be reimbursed for ANY reason. Buyer is responsible for all freight charges including the initial shipment as well as the return. The original freight charges will be deducted froim your refund.
8. We do not charge any restocking charge for a returned vehicle.
9. This price-match guarantee does NOT apply to non-vehicular products, such as parts, tires, accessories, clothing, etc.
10. This guarantee only applies to vehicles purchased from AB Powersports on or after August 1, 2007.

We guarantee to match any competitor's advertised price plus 15% of the difference on any of our vehicles.

Once we have verified that the conditions listed below have been met, we will not only match that price, but subtract another 15% of the difference in price.

For example:

• Our price = $2500
• Our competitor's price = $2300.
• The match price will be $2300 - ($200 x .15) = $2270

This guarantee is subject to the foillowing terms and conditions:

1. We will compare prices for new, direct-from-manufacturer items, excluding any add-ons, options, or other special features which may affec the price.
2. The price you found MUST be our competitor's regular, advertised price for an in-stock item. It may NOT be a special, close-out, discontinued, blemished, year-end, inventory reduction, or any other advertised sale price, nor may it be a price offset by coupons, rebates, dealer incentives, or other one-time price reductions.
3. The item MUST be new and MUST be the exact same make and model (same color, engine size, trim, etc.)
4. This price-match guarantee does NOT apply to non-vehicular products, such as parts, tires, accessories, clothing, etc.
5. Since our products are obtained direct from the manufacturer and we charge no additional fees, the comparison price MUST be a delivered-to-the-customer price including shipping.
6. The price you have found must be from an authorized Internet retail outlet for the same manufacturer. Prices found in auctions (Internet or otherwise), obtained from private individuals or unauthorized Internet sellers, or any other unverifiable source will NOT be considered for price matching.
7. If we are unable to verify the previous condition or the price, we will notify you via email requesting additional information. Our goal is to make this price-match policy as hassle-free as possible. One of the ways you can assist with this is by providing the URL of the specific web page where the competitor's price can be found. We respond as fast as possible to your requests.
8. Price matching requests may NOT be combined with any other coupons, promotional discounts, specials, or other price incentives offered by AB Powersports.
9. Prices and their sources you've found failing to meet the above criteria or in which incomplete/inaccurate information has been provided to us will NOT be eligible for our price-match guarantee.
10. Vehicles that have already been purchased from AB Powersports are NOT eligible for this price-match guarantee.

AB Powersports is a company that believes in support. We do not believe in selling you a product that you cannot find parts for, or call someone for questions about. We have tech support to help you starting with your asembly of the cart end including even the simplest thing as trying to get it started.

No question is a stupid one! We are dedicated to you the customer, you are what makes it all work and we will do what it takes to make you as happy as we can.

AB Powersports, ("Distributor") warrants its products ("Product") against all defects in materials and workmanship for a period of one (1) year from the date of purchase subject only to the following conditions and exclusions:

1. This Limited Warranty is applicable only to:
1. The original purchaser ("Purchaser") and shall not apply to any subsequent owner, assignee, or other recipient of the buggy from the original purchaser.
2. Vehicles purchased:
• Within the United States;
• From Distributor or an authorized dealer thereof.
3. Defective parts only and does not cover any labor charges including, but not limited to:
• Charges incurred for removal of defective parts;
• Charges incurred for installation of replacement parts, or;
• Any additional charges which may be imposed by a Dealer or Service Agent.
2. Purchaser is responsible for all transportation costs and shipping damage incurred to/from Distributor when submitting parts for repair or replacement under this Limited Warranty.
3. Any claim against this Limited Warranty shall in no way be construed as extending warranty coverage beyond the original 1-year period that commenced upon date of purchase.
4. Distributor assumes no responsibility for any warranties beyond the express terms contained in this Limited Warranty. No dealer nor any other person or corporation has any authority to amend this Limited Warranty or make any warranties or representations concerning Distributor, or to extend this warranty beyond the express terms contained herein. Purchaser releases and holds Distributor harmless from any claims stemming from any unauthorized representations.
5. Purchaser holds the Distributor harmless for any consequent injury, loss, or damage resulting from:
1. Defect or malfunction of the Product;
2. Acts of God;
3. Shipping damage;
4. Purchaser misuse, unreasonable use, tampering, abuse, acts of omission, failures to exercise due dilligence, or negligence;
5. Alterations to the Product by any person or entity other than the Distributor.
6. This Limited Warranty shall NOT apply in cases where:
   1. The part has been damaged due to battery leakage.
   2. The Product suffered shipping damage incurred in transit between Distributor and Purchaser. While in such cases, Distributor will do its utmost to supply replacement parts in a timely manner, the Shipper shall be solely liable for all costs incurred due to damage during loading, shipping, and unloading of the Product.
   3. The Purchaser has failed to properly assemble the Product and/or exercise due diligence in ensuring that all all critical nuts, bolts, screws, and other fasteners are both present and properly tightened prior to using the Product.
   4. Parts have been damaged due to improper assembly, excessive force, or failure to follow reasonable mechanical standards.
   5. The Purchaser has failed to properly maintain the Product in accordance with the directions contained in the Owner's Manual provided by Manufacturer, including but not limited to damage incurred due to insufficient engine/transmission oil and/or coolant.
   6. The Purchaser has failed to properly break-in the engine.
   7. The Purchaser has modified the Product in any respect including but not limited to the use of parts other than genuine AB Powersports parts.
   8. The Purchaser has abused or neglected the Product in any way.
   9. The Purchaser used product for rental or race track purposes.
   10. There is an increase in the operational noise level of the transaxle.
   11. The part is a wear item, such as:
   • Tires
   • Batteries
   • Brake pads
   • Clutches & CVT components
   • Drive chains & sprockets
   • Lightbulbs
   • Seat upholstery, rollcage padding/covers, sun shades, arm pads
   • Plastic body panels and fenders
7. These warranties set forth herein are in lieu of any and all other warranties, expressed or implied, including the warranties of merchantability or fitness for specific purpose. Any implied warranty imposed by state consumer law is limited in duration to 1 year from date of purchase.
8. Purchaser represents and agrees that any claims which it may assert against Distributor shall be limited to those which may be asserted under the foregoing limited warranty.
9. This warranty is offered exclusively by AB Powersports. By making a purchase with our company, Purchaser agrees that he/she has read, accepts, and agrees to this Limited Warranty and its terms.

We are not responsible for shipping damage. Should your buggy arrive with any damage, you must file a claim with the shipping company. We will assist you to the best of our ability in any claim process.

We will not be responsible for additional shipping fees incurred due to inaccuracies in the address or phone number provided by you.

Please allow 7-10 business days for shipment. AB Powersports.com shall be held harmless for all shipping delays.

AB Powersports.com ships its dune buggies, mini sand rails, go karts, scooterrs, ATV's, and dirt bikes free of charge to your door anywhere in the United States except Hawaii & Alaska. However, if the truck cannot get to your house, it will be shipped to the trucking company's terminal located nearest to your residence. Call us for additional information.

All dune buggy parts and go kart parts are shipped to your door via UPS and are NOT covered by our free shipping for vehicles.

Pick up is available at our warehouse. Call us for details.

Once they are shipped, there is a 20% restocking fee for all cancelled orders.

All equipment is sold subject to Public Law 90-351, Title III, U.S.D., Section 2511, and any local, state or federal ordinances or international law. Consult your local and state and country laws before ordering if you are in doubt.

Absolutely no sales to minors.

By placing an order, the buyer represents that the products ordered will be used in a lawful manner and that the he/she is of legal age. AB Powersports will not be held liable for the misuse of any product purchased from us or any of our distributors and dealers.

Also as no product is 100% effective against attack, AB Powersports assumes no responsibility if a product purchased from us is not effective in preventing bodily injury, dismemberment or death.

Should your item be confiscated by customs in your country you will NOT be refunded and you waive any rights you may have to deny your payment to us. Again, if you are in doubt check your local laws BEFORE purchasing a Product.

I, the Purchaser, being above age 18, agree to all terms as follows:

• I acknowledge and understand that driving buggies and other motor sports are hazardous and dangerous activities that require strenuous exercise and various degrees of skill and experience for the different surfaces and venues. I understand that these activities can result in serious injury to the person and damage to property and voluntarily assume and any and all risks of loss, damage or injury while using these buggies.
• I am aware of the risks, hazards and dangers of personal injury, death and disability inherent with any and all activities possible with use of this buggy, as well as those inherent risks, hazards and dangers of personal injury, death and disability in participating in any motor sport event. I am aware that the usual risks, hazards and dangers of personal injury, death and disability increase when using inclines, or declines, bowls, jumps, hills or any other structure or device. I also understand that these risks, hazards and dangers are further increased when other persons, whether of the same level of experience or skill, are using the same buggies.
• I hereby agree to release and forever discharge AB Powersports and its agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees which are related to, arise out of, or are in any way connected to my participation or use of the buggies, use of equipment or property supplied by AB Powersports or my presence upon the premises, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of the Seller listed above or the manufacturer or distributor.
• By this Agreement, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from AB Powersports and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf.
• This Agreement shall be effective and binding upon my heirs, agents, personal representatives and assigns.
• I hereby certify that I am over 18 years of age. I have carefully read the foregoing and acknowledge that I understand and agree to all of the above terms and conditions. I have had the opportunity to ask any and all questions regarding this agreement and the effect of the same. I am aware that by purchasing this Product and sending payment for it, I assume all risks and waive and release certain substantial rights that I may have or posses. I there for release all liability and waive any and all rights I may have in regards to my or my child's activities with the above item.
